Use of this website

This website provides information about Prismatics Digital Design services. By using the website, you agree to use it lawfully and not attempt to disrupt, misuse, scrape, attack, or interfere with the site or its forms.

No automatic client relationship

Submitting a form or booking a consultation does not create a client relationship by itself. A project relationship begins only after scope, pricing, payment terms, responsibilities, and approvals are agreed in writing.

Services and proposals

Website, design, development, branding, SEO, IT support, maintenance, and mobile app services are scoped project by project. Proposal terms control the actual deliverables, pricing, milestones, and revision limits.

Published package prices are starting points and may change based on scope, content readiness, features, integrations, and timeline.

Remote services are offered to clients in the United States. On-site services, when accepted, are handled for Illinois-based work or other specifically agreed local engagements.

Client responsibilities

Clients are responsible for providing accurate business information, timely feedback, required assets, account access, approvals, third-party subscription payments, and legally compliant content.

Intellectual property

Ownership of final deliverables should be defined in the signed proposal or agreement. Prismatics Digital Design may retain rights to pre-existing tools, methods, reusable code, design systems, and internal processes unless otherwise agreed in writing.

Clients must have permission to use any logos, images, copy, trademarks, or third-party assets they provide.

Third-party services

Projects may depend on third-party platforms such as Vercel, Google Cloud Storage, Google Cloud database services, hosting providers, CMS tools, domains, analytics, payment processors, booking systems, APIs, app stores, email providers, or software subscriptions.

Third-party services are governed by their own terms, privacy policies, security practices, pricing, uptime, and availability. Prismatics Digital Design is not responsible for third-party outages, policy changes, billing changes, account restrictions, or platform decisions.

Acceptable use

You agree not to use the website, forms, or services for unlawful, abusive, fraudulent, infringing, defamatory, harassing, harmful, deceptive, spam-related, or security-compromising activity.

You agree not to submit malware, credentials, payment card numbers, protected health information, government ID numbers, or confidential third-party information through the general inquiry form.

SEO and performance expectations

SEO, conversion, speed, uptime, and business outcomes depend on many factors outside a single service provider's control. Prismatics Digital Design does not guarantee rankings, revenue, traffic, app approval, or uninterrupted third-party service availability.

Limitation of liability

To the extent permitted by law, Prismatics Digital Design is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or services.

To the extent permitted by law, total liability for a project should not exceed the amount paid for the specific service giving rise to the claim, unless a signed agreement states otherwise or applicable law requires a different result.

Governing law

For remote services provided to U.S. clients, these terms are intended to operate under applicable United States law and the applicable law governing the client relationship or signed agreement.

For Illinois on-site services or Illinois-based local engagements, these terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, unless a signed agreement states otherwise.

Any required venue for Illinois on-site or local-service disputes should be in a court with proper jurisdiction in Illinois, unless the parties agree otherwise in writing.
